Saudi Arabia's new Investment Law, in force since February 2025, has reshaped the way foreign investors enter the market by scrapping the old licensing system in favour of a simpler, fee-free registration with the وزارة الاستثمار. The law repeals the 2000 Foreign Investment Law and establishes equal treatment between foreign and local investors, including access to incentives and protections against expropriation.
Under the updated rules, foreign investors no longer need a separate "foreign investment license." Instead, they must simply register with the وزارة الاستثمار before starting any investment activity — a step that carries no fee in standard cases. Securities regulated under the Capital Market Law, along with domestic Saudi investors and investments in listed securities, debt instruments and investment funds, are exempt from this registration.
Registration and related services are handled online through the ministry's official digital channels, with a target processing time of around five days for typical applications. However, activities on an "excluded list" covering strategic or sensitive sectors still require prior approval from the ministry before investing.
Incentives and penalties
The law gives investment incentives a clear legal footing, allowing competent authorities to grant benefits, facilitations or exemptions based on pre-announced, objective criteria. Common incentives include loan programs for industrial and strategic projects, energy and utility subsidies in industrial cities, employment support and wage subsidies, export financing, and customs duty exemptions on specified materials and equipment.
On 11 January 2025, a Standard Incentives Program for the industrial sector was launched with a budget of SAR 10 billion, aimed at strengthening local manufacturing and cutting imports, open to qualifying foreign and domestic investors under defined criteria.
To keep the system fair, the law sets a maximum administrative fine of SAR 300,000, which can be doubled for repeat violations, along with possible cancellation of investor registration for serious or repeated breaches. For residents and business owners, the reforms signal a faster, lower-cost path to investing in the Kingdom in line with رؤية السعودية 2030.
