Cabinet Extends Deadline to Document Old Property Deals

Property owners across the Kingdom now have extra time to formally document old real estate deals, after the Cabinet approved a one-year extension of the correction period for undocumented transactions. The extension applies to transactions completed before 14 Safar 1442 AH (2 October 2020) on properties that already have an official title deed.

Under Royal Decree M/84 dated 19/3/1446 AH, and a Cabinet decision issued in Safar 1448 AH, the extended window runs for one full Hijri year starting from 12/10/1447 AH. The measure covers a wide range of deals — sales, purchases, gifts, transfers of ownership, and transfers of undivided shares — where the transaction was carried out but never registered at the notary office.

The initiative is tied to the Real Estate Transaction Tax (RETT) system, which took effect on 2 October 2020. The correction period specifically targets deals concluded before that date, giving owners a clear path to bring their records into line with current requirements.

Eligible cases also include situations where a partner transferred property into a company's name without formal documentation. Those transfers must be recorded in company records, with proof submitted to the Zakat, Tax and Customs Authority within the rectification period.

How to rectify a transaction

Owners are generally advised to gather original paper sale, gift, or transfer contracts along with supporting documents proving the date of the deal, such as old deeds or payment receipts. The property should have an official title deed issued by the competent authority. Requests to document the transaction can be submitted through the Ministry of Justice's real estate and notarization channels, typically via ناجز electronic services or directly at a notary office.

Officials say the goal is to complete the formal documentation of ownership and improve the efficiency and transparency of the real estate market — a benefit for residents and expats alike who hold undocumented properties.
