Opening a bankruptcy procedure in Saudi Arabia does not automatically mean a business must close or exit the market. Under the Bankruptcy Law, several procedures are designed to keep companies operating while their debts are reorganized, rather than pushing them straight into liquidation.
The law offers distinct paths. Under a protective (preventive) settlement, the debtor stays in control and negotiates with creditors under court supervision to avoid liquidation while continuing to operate. In financial restructuring, a licensed trustee leads a court-supervised process aimed at business continuity with restructured debts. Only liquidation — the sale of assets and distribution of proceeds to creditors — typically results in the firm leaving the market.
Applications are submitted electronically through the Iflas (إفلاس) platform and are then filed before the competent Commercial Court. The ناجز platform of the Ministry of Justice provides access to the bankruptcy filings database and related court e-services, with login via نفاذ. Platforms such as أبشر, مقيم and قوى are not used to file bankruptcy procedures and may only be involved indirectly for related labor or municipal matters.
Why it matters
The opening of a procedure is published in the official Bankruptcy Register, but publication does not signal that the business has stopped operating. For a corporate debtor, initiating a case usually requires confirming insolvency or imminent insolvency, then preparing audited financial statements, a detailed list of assets and liabilities, a creditor list with amounts and security, and relevant contracts or a restructuring report.
The court then appoints a trustee for restructuring or liquidation, or oversees the settlement. For business owners, employees and creditors alike, understanding these options can mean the difference between a company recovering and one being wound down.
