Bankruptcy Filing Does Not Mean Closing a Business

The Saudi bankruptcy committee has moved to clear up a common misconception among business owners: filing for bankruptcy does not automatically mean a company must shut down, leave the market, or be liquidated. The clarification is aimed at reducing the stigma often attached to insolvency procedures.

protective settlement and financial restructuring are designed specifically to help viable businesses reorganize their affairs and keep operating. Liquidation, by contrast, applies only to businesses that cannot continue, and it follows an orderly process of realizing assets and protecting creditors.

How the process works

Insolvency information is published through the Najiz platform, part of the Ministry of Justice's bankruptcy filings database. Users sign in using National Single Sign-On credentials to view filed insolvency applications and related case details. Filed applications are handled through the competent court and displayed on the platform. Creditors are given a claims window that has been publicly stated as up to 60 days to submit their claims in bankruptcy-related cases.

The committee reported that 60 bankruptcy-related announcements were published in June 2026, including 30 notices opening bankruptcy proceedings.

For the business community across the Kingdom, the message matters. Entrepreneurs and small business owners who face financial difficulty now have clearer options: rather than assuming the end of their venture, they may pursue restructuring or a protective settlement that keeps operations running while obligations are reorganized. This supports business continuity and protects jobs, while still safeguarding the rights of creditors through a transparent, court-supervised framework.
